Community Infrastructure Levy (CIL) is calculated per square metre. The calculation involves multiplying the CIL charging rate by the net chargeable floor area (based on gross internal area), and factoring in an indexation figure.

The responsibility to pay the levy lies with the owner of the land, unless liability is assumed by another person or party - please see our CIL process page for further information on assuming liability.

Charging rates
The rates for West Berkshire will be charged on residential (C3 and C4) and retail (previously A1 to A5) development (see table below). You can also read more about the types of development liable for CIL on our 'chargeable development types' page. As explained above, the rate is per square meter and is then multiplied by the net chargeable floor area and an indexation figure.
The following tables set out the amount of CIL charged per square metre (with indexation) for developments permitted in 2024. There are different rates depending on whether the development is in the 'Newbury and Thatcham and Eastern Urban Area' or the 'Area of Outstanding Natural Beauty, and East Kennet Valley'.

From 1 September 2020, the Town and Country Planning (Use Classes) Regulations 2020 will come into effect. These regulations remove the former A and D use classes, and create three new use classes: class E, class F.1 and class F.2.
Retail development formerly in the A use classes, including shops and restaurants, will remain CIL chargeable. CIL liability notices will continue to be issued for retail development in line with the CIL charging schedule.
The government has confirmed that, 'if a CIL rate has been applied to A1-A5 Use Classes prior to 1 September 2020, that rate should remain applicable to the development uses previously contained within the A1-A5 Use Classes' - GOV.UK - Community Infrastructure Levy.
Indexation
In line with the 2019 regulation amendments, when calculating individual charges for the levy, collecting authorities are required to apply an index of inflation to keep the levy responsive to market conditions. Please see the RICS website - Community Infrastructure Levy Index.

These rates have been calculated by applying the formula 'R x Iy over Ic'. In this formula:
- R is the rate at which CIL is charged in the adopted West Berkshire CIL charging schedule (2015) - you can see this on our 'previous charging rates' page
- Ic is the index figure for the calendar year 2015 ("the year in which the charging schedule containing rate R took effect") - this figure was 256
- Iy is the index figure for the calendar year 2024, as published by the Royal Institute of Chartered Surveyors (RICS) - this is 381

When you need to pay CIL
The CIL charging schedule sets out how CIL is calculated and what development is liable. Please note that if your development is indicated to be a development type for which CIL is not payable such as those set out in paragraph 1.7 of the CIL charging schedule (residential extensions and annexes, self-build housing and change of use etc) an application for relief or exemption must be made prior to commencement of development or the Council will be unable to grant relief or exemption.

The Community Infrastructure Levy is payable in accordance with the instalment policy shown below:

The commencement date is the date given on the commencement notice, as advised by the liable party under regulation 67.
If you do not submit a commencement notice in accordance with the regulations, we will remove your ability to pay in instalments. Full payment would then be due within 60 days of commencement, including payment of the surcharge, as detailed in part 9 of the regulations.
This instalment plan is subject to change at any time in accordance with regulation 69B of the CIL (amendment) Regulations 2011.

You can make a CIL payment several ways:
- BACS and online banking - please use the CIL demand notice/invoice number as the payment reference
- By cheque - cheques should be made payable to West Berkshire District Council, and sent to the Development Contributions Team at our Market Street Offices, Newbury, RG14 5LD - please include the demand notice/invoice number (and planning application number) on the reverse of the cheque
If you do not use the correct CIL reference number when making a payment, it could delay acknowledgement of your payment and may result in further payment requests.
