Section 106 agreements (developer contributions)

Information about section 106 agreements and how to make a compliance request.

Section 106 agreements are legally binding agreements, entered into by individuals or groups (often a developer) with an interest in a piece of land. They are used to secure the delivery of on-site infrastructure or financial obligations, which will be used to fund infrastructure improvements.

On-site infrastructure that may be provided as a result of a section 106 agreement includes:

  • affordable housing
  • public open spaces and play areas
  • habitat protection
  • access roads

In West Berkshire, all eligible developments must pay towards the Community Infrastructure Levy (CIL), as well as any site-specific requirements secured through Section 106 agreements.

You can find detailed information about West Berkshire specific planning obligations in our Planning Obligations Supplementary Planning Document (SPD). You can find National Guidance on the GOV.UK website.
